Divorce

Custody

Florida uses the term Parenting-Time and typically defaults to allowing each parent continuous and regular time with their children. It is the public policy of Florida to ensure that each minor child has frequent and continuing contact with both parents and to encourage parents to share the rights and responsibilities of raising children.

Only in the rare circumstance where the court determines that shared parental responsibility would be detrimental to the child, will the court award sole parental responsibility to one parent.

The court uses the best-interest-of-the-child standard when considering parental issues.

Child Support

In Florida, both parents have an obligation to financially support their children in accordance with income and needs. Florida has developed a formula that is used to determine the amount of monthly support owed.

Division of Assets and Debts

Florida statutes and case law provide for an "equitable distribution" of marital assets and debts. Equitable distribution is based on a long list of factors the court is required to consider.

Alimony

There are several types of alimony awards in Florida, from lifetime to durational, the particular circumstances in the marriage are used when determining which, or if any, should be awarded. The main criteria used if whether there is a need by one spouse and an ability to pay by the other.

Modifications

Often, divorce settlements contain terms that have become unreasonable due to a life change. However, there is hope. Florida law permits modifications of divorce settlements and/or judgments where there has been an unanticipated and significant change in circumstances.
